1.Agreement to These Terms
These Terms of Service (“Terms”) form a binding agreement between you and NextGen PGx governing your purchase and use of our pharmacogenomic (PGx) testing services, website, and patient portal. By ordering a test, activating a kit, or using our services, you agree to these Terms.
If you do not agree, do not use our services. You must be at least 18 years old and legally capable of providing consent to use our services.
2.Description of Our Service
NextGen PGx provides a direct-to-consumer pharmacogenomic test. You order a kit online, collect a sample at home, return it using the prepaid packaging, and receive a report indicating how certain genetic variants you carry may affect how your body processes certain medications.
Testing is performed by certified laboratories. Your results are released to your secure patient portal and, at your option, to a healthcare provider you designate.
3.Orders, Payment, and Refunds
- All prices are shown at checkout and are subject to change; the price in effect when you complete checkout is the price that applies to your order.
- We accept the payment methods displayed at checkout. Your order is confirmed by email once payment is processed.
- You may cancel your order for a full refund any time before your kit ships. After shipment, our refund policy for returned, unactivated kits is described at checkout and in your order confirmation.
- We may refuse or cancel orders in cases of suspected fraud, eligibility restrictions, or where we cannot lawfully provide testing in your jurisdiction.
4.Kit Use, Sample Collection, and Recollection
- You agree to follow the collection instructions included with your kit and to register (activate) the kit before or upon use, providing accurate identity information so results can be correctly matched to you.
- Specimens must be returned within the timeframe stated in your kit instructions. Specimens that arrive damaged, degraded, or otherwise unusable may require a recollection.
- If your specimen cannot be analyzed, we will notify you and, at our discretion, provide one replacement kit at no additional charge.
- Tampering with kit identifiers, QR codes, or another person's kit is prohibited and may result in termination of your access to our services.
5.Consent to Testing and Data Processing
PGx testing requires your informed consent. During checkout and kit activation you will be asked to accept our consent documents, including consent for testing, use of your data as described in our Privacy Policy, and (where applicable) sharing results with a provider you designate.
You may withdraw consent for optional uses at any time, but withdrawal does not affect testing already performed or legal obligations we must satisfy.
6.Important Medical Disclaimer
Our PGx report is an informational tool, not a diagnosis, prescription, or medical advice.
Do not start, stop, or change any medication or dose based on your results alone. Always review your results with an appropriately qualified healthcare professional who knows your full medical history. Your prescriber remains responsible for all medication decisions.
PGx testing analyzes specific gene variants known to affect medication response; it does not screen for diseases, predict all drug reactions, or account for every factor that influences how you respond to a medication (such as other medications, kidney or liver function, age, or diet).
In an emergency, call 911 or your local emergency number — do not wait for results.
7.Intellectual Property
The NextGen PGx website, kit materials, reports, branding, and software are owned by or licensed to NextGen PGx and are protected by intellectual property laws. You receive a limited, personal right to view and use your own report; you may not copy, redistribute, or commercialize our materials without written permission.
8.Disclaimers and Warranties
Our services are provided “as is” and “as available,” without warranties of any kind, except those that cannot be disclaimed by law. We do not warrant that results will be error-free or that the service will be uninterrupted.
While we use laboratory and quality controls consistent with industry standards, no laboratory test is 100% accurate, and results may be affected by sample quality.
9.Limitation of Liability
To the maximum extent permitted by law, NextGen PGx's total liability arising from or related to our services is limited to the amount you paid for your test, and we are not liable for indirect, incidental, special, consequential, or punitive damages.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
10.Disputes and Governing Law
These Terms are governed by the laws of the state in which NextGen PGx is organized, without regard to conflict-of-law rules. You agree to attempt to resolve disputes informally by contacting us first.
Any dispute that cannot be resolved informally shall be resolved by binding arbitration or in the courts of that state, as permitted by applicable law, and you agree to venue there. Either party may bring a claim in small-claims court instead.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
11.Changes and Termination
We may update these Terms from time to time. We will notify patients of material changes by email or portal notice and post the updated version with a new “Last updated” date. Continued use after changes take effect means you accept the updated Terms.
You may stop using our services at any time, subject to completing any outstanding order you have placed. We may suspend or terminate access for violation of these Terms, fraud, or where required by law.
